Article 1. IN GENERAL |
§ 82.010. School bus stop arm violations as civil offenses.
(a)
The owner of a motor vehicle that is operated in violation of V.T.C.A., Transportation Code § 545.066, as amended, by passing a stopped school bus displaying the visual signals required by V.T.C.A., Transportation Code § 547.701(c), as amended, commits a civil offense and is liable for a civil fine of $300.00 per violation.
(b)
The city council may contract with another local government in accordance with V.T.C.A., Government Code Ch. 791 to enforce and administer this section ("outside administrator"). The city or outside administrator shall implement and enforce this article and may establish such rules or regulations, not inconsistent with this article, as are necessary to effect this section.

Editor's note
Section 2 of Ord. No. 2013-75 states, "That the attached "Procedures for Administration of the City of San Marcos School Bus Stop Arm Ordinance" shall take effect and remain in effect unless and until revised by mutual agreement of the city and the Outside Administrator."
