§ 66.001. Definitions.

  • In this chapter:

    Bag means a plastic sack used to store solid waste with sufficient wall strength to maintain physical integrity under normal loading when lifted by the top.

    Bulky waste consists of three cubic yards or less of Freon-free appliances, furniture and other large waste materials, construction debris, or items that do not fit in the cart other than dead animals, hazardous waste or stable matter.

    Bundle means tree, shrub and brush trimmings or newspapers and magazines securely tied together forming an easily handled package not exceeding four feet in length or 35 pounds in weight.

    Cart means a 35, 65 or 96-gallon capacity plastic container with attached lid and wheels designed to be lifted and emptied mechanically.

    Collection means the removal and transportation of materials from the pickup-point to the approved processing or disposal site.

    Collection center means contractor provided facility including real property, utilities, buildings, equipment, and personnel used in the collection, sorting, staging, and processing of single stream recyclable materials received from customers.

    Collection site means a location at a multifamily unit used to collect multifamily single stream recyclable materials which will consist of containers of sufficient number and size for single-stream recycling collection.

    Construction debris means waste resulting from construction and/or demolition projects, including all materials that are directly or indirectly the by-products of residential construction work or that result from demolition of buildings and other structures, including, but not limited to, paper, cartons, gypsum board, wood, rubber and plastics.

    Curbside collection means collection service rendered at a residence or duplex not served by an alley, public utility easement or other public way in the rear or alongside thereof, involving the placement of containers for collection at or near the curb of the street abutting such property.

    Dead animal means any dead animal or part of an animal greater than ten pounds in weight other than those processed for human use.

    Director means the director of public services or whatever director or department director designated by the city manager.

    Dwelling unit or dwelling means any group of rooms located within a residential or multifamily unit and forming a single habitable unit with facilities which are used, or are intended to be used, for living, sleeping, cooking and eating.

    Garbage means decayable solid waste, including dead animals, animal and vegetable waste, food containers, and all other waste matter which is likely to attract flies or vermin, except any matter included in the definition of bulky waste, dead animal, hazardous waste, rubbish or stable matter.

    Garbage container means a plastic, metal or fiberglass receptacle used to store garbage and rubbish.

    Hazardous waste means any chemical, compound, mixture, substance or article designated as a "hazardous waste" under state or federal law.

    Multifamily unit means a townhouse, apartment, condominium unit or other multifamily dwelling that contains five or more dwelling units.

    Recyclable materials means garage or rubbish material that still has useful physical or chemical properties after serving its original purpose and that can be reused or remanufactured into other products.

    Recycling center means a facility operated by a private contractor that is open to the public and to city offices for deposit of recyclable materials.

    Recycling center services means the operation of a facility operated by a private contractor for deposit of recyclable materials by the public and by city offices.

    Residential solid waste means solid waste generated by a producer at a residential unit.

    Residential unit means a single-family dwelling, townhouse, apartment, condominium or other single-family dwelling that contains four or fewer dwelling units.

    Rubbish means solid waste that is not readily decayable, including wood, wood products, grass cuttings, plants, leaves, paper, cardboard, cloth, leather, footwear, ashes, cinders, floor sweepings, glass, mineral or metallic materials, and all other waste materials other than bulky waste, construction debris, garbage, hazardous waste, stable matter, tree trimmings or yard waste.

    Single stream recycling means co-mingled collection, transportation, and processing of recyclable materials. All classes of materials (i.e. glass, paper, metals and plastics) are collected in one container either by mechanical or manual means for transport to a recyclable materials processing facility for automated sorting and processing.

    Solid waste includes garbage, rubbish, bulky waste, construction debris, and stable matter.

    Stable matter means all manure and other waste matter normally accumulated in an animal, livestock or poultry stable or enclosure and resulting from the keeping of animals, poultry or livestock.

    Unacceptable waste means any and all waste that is either:

    (1)

    Waste which is now or in the future prohibited from disposal at a sanitary landfill by state or federal laws or the regulations promulgated thereunder;

    (2)

    Hazardous waste, as defined herein;

    (3)

    Special waste, as defined by the laws of the United States or the State of Texas or the regulations promulgated thereunder;

    (4)

    Tires, concrete, and bulk petroleum or chemical products or by-products;

    (5)

    Septic tank pumping and grease and grit trap wastes;

    (6)

    Sludge waste, including water supply treatment plant sludges and stabilized and/or unstabilized sludges from municipal or industrial wastewater treatment plants;

    (7)

    Medical waste, including infectious or pathological waste from laboratories, research facilities, and health and veterinary facilities, and sharp objects such as syringes that are not in a protective sealed container;

    (8)

    Liquid waste, which for the purposes of this contract means any waste material that is determined to be or contain "free liquid" by the paint filter test (EPA Method 9095);

    (9)

    Waste from an industrial process;

    (10)

    Waste from a pollution control process;

    (11)

    Waste transported in a bulk tanker;

    (12)

    Friable and/or nonfriable asbestos waste;

    (13)

    Empty containers which have been used for pesticides, herbicides, fungicides, or rodenticides; or containerized waste (e.g., a drum, barrel, portable tank, box, pail, etc.) of a type listed in this definition;

    (14)

    Residue or debris from the cleanup of a spill or release of chemical substances, commercial products or other wastes listed in this definition;

    (15)

    Soil, water, residue, debris or articles which are contaminated from the cleanup of a site or facility formerly used for the generation, storage, treatment, recycling, reclamation, or disposal of wastes listed in this definition, including soil contaminated from underground storage tanks used or formerly used for the storage of petroleum products;

    (16)

    Any waste that requires other than normal handling, storage, management and/or disposal, as determined by the director;

    (17)

    Dead animals greater than ten pounds in weight and/or slaughterhouse waste, except for animals euthanized under the authority and direction of the city; or

    (18)

    Any waste which because of its quantity, concentration, frequency of disposal, required disposal procedures, regulatory status, or physical, chemical infectious or other characteristics jeopardizes or may jeopardize the environmentally sound operation of a disposal site, as determined by the director.

    Yard waste means tree limbs, grass and plant clippings, and tree or brush trimmings that are bagged or bundled for curbside yard waste collection.
