§ 46.077. Discrimination in sale or rental of housing.

  • (a)

    It is unlawful for a person to refuse to sell or rent a dwelling to a person who has made a bona fide offer; or refuse to negotiate for the sale or rental of a dwelling; or otherwise make unavailable or deny or prohibit a dwelling to any person because of the person's sex, race, color, religion, familial status or national origin.

    (b)

    It is unlawful for a person to discriminate against any person in the terms, conditions, or privileges of the sale or rental of a dwelling or in the provision of services and facilities in connection with a sale or rental of a dwelling, because of race, color, religion, sex, familial status or national origin.

    (c)

    This section does not prohibit discrimination against a person because the person has been convicted under federal law or the law of any state of the illegal manufacture or distribution of a controlled substance.
